the bidder/buyer agrees to the following terms and conditions:
Disclaimer
All lots sell as is, where is, with all faults. McLemore Auction
Company, LLC and the seller do not give or make any type of guarantee
or warranty regarding the lots to be sold, implied or otherwise.
McLemore Auction Company, LLC encourages all bidders to inspect lots in
person before bidding. McLemore Auction Company, LLC is not responsible
for incorrect listing information, if any. McLemore Auction Company,
LLC has attempted to provide accurate descriptions of all items,
however, it is the bidder's responsibility to determine the condition
and suitability of each lot. Printed statements or descriptions by
McLemore Auction Company, LLC staff are provided in good faith and are
matters of opinion.
No Returns
All sales are final. There are no returns, refunds, or adjustments.
Buyer's Premium
A buyers' premium of ten percent (10%) of the high bid will be added to
the high bid to determine the final selling price for the auction lot.
Sales Tax
All sales will be exempt of sales tax.
Payment
All buyers must pay for their purchases in full at the conclusion of
the auction.
McLemore Auction Company, LLC
accepts the following forms of payment:
- Cash
- Personal and company checks (there will be a
$35.00 charge for all returned checks)
- MasterCard, Visa, American Express and Discover
Merchandise
becomes the full responsibility of the buyer at the conclusion of
bidding on each and any individual lot and the buyer assumes all risk
of loss and damage to property at that time. McLemore Auction Company,
LLC reserves the right to resell any property not paid for at the
conclusion of the auction. In any such event, the Buyer will still be
responsible for payment for the original purchase and the costs of
collection of this payment and/or damages resulting from the resale of
the property.
Inspection
All
items in this auction are available for inspection at 741
Goodpasture Terrace, Nashville, TN 37221 according
to the schedule below:
Friday, May 16, 2008
from 2:00 PM to 6:00 PM CT and
Saturday, May
17, 9:00 AM CT until auction
conclusion.
Pickup
All items, may be picked up from their current location once McLemore
Auction Company, LLC has received and acknowledged payment in full.
Buyers are responsible for rigging, loading, and moving all items
purchased without assistance from McLemore Auction Company, LLC.
Shipping
If you request, McLemore Auction Company, LLC will ship items that will
fit into a box or tube of reasonable size. Buyers will pay for the cost
of shipping via UPS plus $10.00 per box or tube shipped. McLemore
Auction Company, LLC will attempt to consolidate multiple items
purchased by a single buyer, but this may not always be possible.
Items requiring special care or
very large items must be shipped by a professional shipping company and
may result in higher shipping costs. There are several moving and shipping
companies that are willing to provide shipping services for this
auction.
Debt Collection and Interest Charges
The buyer agrees to pay all reasonable attorney fees and other costs
incurred by McLemore Auction Company, LLC in its efforts to collect
unpaid funds from the buyer. The buyer agrees that a fee of 2% of the
outstanding balance per month be added to any unpaid balance due
McLemore Auction Company, LLC. Any debt collection or dispute
proceedings will be heard in Davidson County, Tennessee.
Age Requirement
All bidders must be 18 years of age or older.
